Duty Drawback on Destroyed Bikes and Component Returns

Please read: this guide is general information, not legal or customs advice, and rates and examples are illustrative. Drawback claims must be completed within 5 years of the date of importation (19 U.S.C. 1313(r)). Destruction claims require destruction under CBP supervision with advance notice, and DrawbackIQ currently prepares unused-merchandise export claims only. Your licensed customs broker decides what can be filed.

Bikes and bike components that are destroyed due to damage, obsolescence, or returns are eligible for duty drawback. Bike importers and retailers with damage or destruction events have a straightforward opportunity to recover duties on inventory that is already costing them money to dispose of.

Common Destruction Scenarios for Bikes

Bikes and components are destroyed for several reasons: (1) frame or component damage during shipping from overseas; (2) defects discovered during assembly or quality inspection; (3) returned bikes that cannot be refurbished; (4) obsolete models at end of season; and (5) scratch-and-dent inventory from fulfillment centers. Destruction is documented through recycling facility invoices, facility disposal records, or waste processor certificates.

Destroyed Bikes Refund Opportunity

The statute refunds 99 percent of eligible duties on destroyed merchandise. Bikes destroyed as waste qualify fully. If your damage rate or obsolescence rate is 3 to 8 percent of annual imports (common for bikes due to shipping damage), the refundable amount is substantial over five years.

Example: Destroyed Bikes Refund

A bike importer enters $4 million annually at an average 5.5 percent duty rate. Five percent of inventory is destroyed annually due to damage and obsolescence. Over 5 years, the estimated refund on destroyed bikes is approximately $54,450. This is cash on inventory that was already written off.

Documentation for Destroyed Bike Claims

Your broker will need: (1) CBP import entries; (2) destruction records (recycling facility invoices, disposal logs, facility destruction certificates); (3) quantities destroyed matched to import entries by SKU or component type; (4) proof of destruction. Most bike importers and retailers have waste disposal contracts that provide these documents.

Damaged Bikes from Shipping

Bikes that arrive damaged from overseas suppliers and are deemed uneconomical to repair are refundable at 99 percent. This is one of the well-documented destruction scenarios because you have documentation of the damage, the quantity, and the disposal decision.

End-of-Season and Obsolete Inventory

Bike models that do not sell and are destroyed at season end are eligible. If you track by model and destruction date, matching to import entries is straightforward. End-of-season destruction can represent 3 to 10 percent of annual import volume depending on your product turnover model.
