These Terms of Service ("Terms") govern access to and use of DrawbackIQ (the "Service"), operated by Buckshot Digital Sales Inc. ("DrawbackIQ," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent ("you" or "your").
DrawbackIQ is a software platform that helps importers and exporters identify, calculate, and manage potential U.S. Customs and Border Protection (CBP) duty drawback claims. The Service ingests import and export shipment data you provide, applies eligibility and matching rules to estimate potential drawback refunds, and helps you prepare claim packages.
DrawbackIQ is not a licensed customs broker, attorney, or accountant, and nothing in the Service constitutes customs brokerage services, legal advice, or tax advice. Filing an actual drawback claim with CBP may require the involvement of a licensed customs broker. You are responsible for verifying the accuracy of any claim before it is filed and for complying with all applicable customs laws and regulations.
You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at info@bdsalesinc.ca if you suspect unauthorized access.
You retain ownership of the import, export, and shipment data you submit to the Service ("Customer Data"). You represent that you have the right to submit Customer Data to us and that doing so does not violate any law or third-party right. We process Customer Data to provide the Service, as described in our Privacy Policy.
Certain features of the Service are billed on a contingency basis: a percentage of the drawback refund amount associated with a finalized claim, as configured for your organization and disclosed to you before a claim is finalized. Invoices are issued and processed through our payment processor, Stripe. Fees are due according to the terms stated on each invoice. Amounts are non-refundable except as required by law.
Calculations, eligibility determinations, and refund estimates produced by the Service are based on the data you provide and our current understanding of applicable drawback rules, which may change. We do not guarantee that any estimated amount will match the amount CBP ultimately allows, or that any claim will be approved. You are solely responsible for reviewing all claim data before submission to CBP.

We may suspend or terminate access to the Service if you breach these Terms, if required by law, or if fees are not paid. You may stop using the Service and close your account at any time by contacting info@bdsalesinc.ca. On termination, we will handle your data as described in our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DRAWBACK CLAIM WILL BE APPROVED BY CBP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAWBACKIQ AND BUCKSHOT DIGITAL SALES INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE FEES YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
You agree to indemnify and hold DrawbackIQ and Buckshot Digital Sales Inc. harmless from any claims, losses, or damages arising from your Customer Data, your use of the Service, or your violation of these Terms or applicable law.
We may update these Terms from time to time. If we make material changes, we will provide notice (such as by email or an in-app notice). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
